The DOS released its August 2026 Visa Bulletin. USCIS has determined that, when determining filing eligibility for August 2026, family-sponsored applicants should reference the Dates for Filing chart, while employment-based applicants should reference the Final Action Dates chart.
Next month’s charts appear below. A date listed for any class indicates that the class is oversubscribed. “C” means current (i.e., numbers are authorized for issuance to all qualified applicants). “U” means unauthorized (i.e., numbers are not authorized for issuance).
EB-2: Possibility of Retrogression or Unavailability for FY 2026
The Department of State notes that “sufficient demand and increased number use in the EB-2 visa category may make it necessary to retrogress the final action date or make the category unavailable in the coming months to hold number use within the maximum allowed under the FY 2026 annual limit,” i.e. until FY 2027 begins in October 2026.
EB-1 India: Possibility of Unavailability for FY 2026
The Department of State notes that “high demand and number use by aliens chargeable to India in the EB-1 visa category may necessitate making the category unavailable in the coming weeks if India’s pro-rated limit in the EB-1 category is reached before the fiscal year ends” on September 30, 2026.
