Managing Partner Nicole Simon was recently interviewed by WHYY News as a leading voice on the Trump administration’s sweeping changes to the green card application process. In a piece published June 1, 2026, WHYY reporter Emily Neil turned to Nicole to help explain what the new USCIS policy memo means for applicants, their families, and their employers. (For a detailed breakdown of the policy itself, see our recent alert on the USCIS announcement.) In the article, Nicole explains how the government’s proposed changes turn what was “a discretionary ability to adjust” into “something much more narrow,” deeming that the ability to adjust now “needs to be extraordinary circumstances, so it will be the exception rather than the rule.”
She also challenged the legal foundation of the memo, calling it a reversal of 70-plus years of established case law and practice with no sound legal basis, and predicting that court challenges will follow.
During the interview, Nicole emphasized the toll the memo would take on immigrants and their families, noting that beyond the legal and logistical disruption, the immediate impact of the government’s memo is to create anxiety and uncertainty among those seeking permanent residence in the United States. “Everyone’s really worried, and that’s really what the issue is,” she said. “I think more than anything, it’s the chaos, and the concern, and the anxiety.”
