USCIS Removes Automatic Extension of EADs

On October 30, 2025, DHS published an Interim Final Rule removing the automatic extension of EADs. This Interim Final Rule is effective immediately and provides the opportunity for public comment. This means that individuals who timely file an application to renew their EAD on or after October 30, 2025, will no longer receive an automatic extension of their EAD. This will not impact the automatic extension applied to EADs for those who applied prior to October 30, 2025.

This rule will also not impact the following EAD renewal categories:

TPS-related EADs, so long as the individual still meets the requirements for TPS; and
F-1 STEM OPT applicants who will continue to be eligible for a 180-day automatic extension of their initial 12 month OPT work authorization.

DHS argues that removing the automatic extension will allow the government “to prioritize the proper vetting and screening of aliens before granting a new period of employment authorization and/or a new EAD.” For individuals with EADs expiring in the future, it is important to submit the renewal application as early as possible so that you do not experience a temporary lapse in work authorization. USCIS recommends filing a renewal application up to 180 days prior to the EADs expiration.
