A Turning Point for Venezuelan TPS Holders Following the Supreme Court’s Decision

On May 19, 2025, the U.S. Supreme Court issued a brief allowing the Department of Homeland Security (“DHS”) to proceed with the termination of the 2023 TPS designation for Venezuelans, which lifted a Federal Court’s injunction that had temporarily blocked the move.

As a result of the Supreme Court’s decision, the immediate legal consequences for Venezuelan TPS beneficiaries vary:
  • 2023 Venezuelan TPS Designation Recipients: May suffer the immediate loss of TPS status and work authorization unless they qualify for another form of relief, asylum or alternative immigration options.
  • 2021 Venezuelan TPS Designation Recipients: Unaffected by the Supreme Court decision, and their TPS status and work authorization is valid until September 10, 2025.
