The U.S. Department of State has provided updated guidance on eligibility for National Interest Exceptions to three Presidential Proclamations which restrict entry into the U.S. for individuals who have been physically present in the Schengen Area, United Kingdom, Ireland, Brazil, China, South Africa, or Iran within the past 14 days.
This update provides that travel to the U.S. on an immigrant or K fiancé(e) visa is in the national interest for purposes of granting an exception. Applicants for immigrant and fiancé(e) visas should check the website of the nearest consulate for updates on which visa services are available. Visa applicants will be considered for a National Interest Exception at the time of their interview. Please also note that U.S. Consulates continue to operate at a reduced capacity even after resuming visa services.
The updated guidance also announced eligibility for a National Interest Exception for some Exchange Visitors, pilots, and aircrew falling within a list of specific circumstances. Please contact your LHSCD attorney or request a consultation if you have questions.
