USCIS to Resume Premium Processing for All H-1B Petitions Filed Before 12/21/18

USCIS has announced that it will resume accepting Requests for Premium Processing Service for all H-1B petitions filed on or before December 21, 2018. USCIS had previously announced temporary suspensions of premium processing of certain H-1B petitions, but has been resuming premium processing “as agency workloads permit.”

Some H-1B petitions filed after December 21, 2018 remain eligible for Premium Processing, including:

  • H-1B petitions filed at the California Service Center where the employer is cap-exempt or where the beneficiary will be employed at a qualifying cap-exempt institution; and
  • H-1B petitions filed at the Nebraska Service Center to extend previously-approved employment without change with the same employer

H-1B petitions filed after December 21, 2018 that do not fall into either of the above categories remain ineligible for Premium Processing until further notice.
