USCIS and E-Verify Announce Compliance with Court Order Postponing Vacatur of TPS for Venezuela

Court Order on TPS for Venezuela

On March 31, 2025, the United States District Court for the Northern District of California issued an order that postpones the vacatur and termination of the 2023 TPS designation for Venezuela, which the Trump administration had announced in February. As a result, the 2023 TPS designation for Venezuela will remain in effect at this time.

Extension of Employment Authorization Documents (EADs)

In light of the court’s order, USCIS announced an extension of the validity of Employment Authorization Documents (EADs) issued under the Venezuela TPS designations. Specifically, EADs with the following expiration dates and categories are now valid through April 2, 2026, pending further litigation:

  • EAD Expiration Dates: September 10, 2025; April 2, 2025; March 10, 2024; or September 9, 2022
  • Categories: A12 or C19

Impact on E-Verify I-9 Compliance

The Department of Homeland Security has provided guidance related to this court order for employers using E-Verify. When creating an E-Verify case for a new employee who has completed Form I-9, employers should enter the EAD document number along with the automatically extended expiration date of April 2, 2026. Employers are also encouraged to continue to check the TPS webpage for updates.
