In an unpublished notice, DHS announced its decision to terminate the October 3, 2023, Designation of Venezuela for Temporary Protected Status (“TPS”). The publication date is set for February 5, 2025, and the termination will go into effect sixty (60) days after publication in the Federal Register. This coincides with the original expiration date of April 2, 2025, for the 2023 Designation. The 2021 Designation of Venezuela for TPS has not been terminated and will remain in effect until September 10, 2025.
The DHS Secretary can determine whether conditions for TPS designation have been met at least sixty (60) days prior to the expiration of a country’s TPS designation. The Secretary determined that the conditions in Venezuela have changed and therefore TPS will be revoked. TPS was initially granted because of “extraordinary and temporary conditions in that country that prevented the safe return of Venezuelan nationals, and that permitting such Venezuelan nationals to remain temporarily in the United States is not contrary to the U.S. national interest.” However, now the DHS Sectary that it is “contrary to the national interest to permit the covered Venezuelan nationals to remain temporarily in the United States.” This termination will impact hundreds of thousands of Venezuelans who have sought shelter in the U.S. Once TPS is terminated, Venezuelan nationals will no longer have status in the U.S. and can be subjected to deportation. Furthermore, Venezuelan nationals will also lose their Employment Authorization under TPS.
