As reported by Forbes and alluded to in President Trump’s prior proclamation banning certain immigrant visa holders from entering the U.S., the president will likely sign a proclamation shortly that will bar temporarily H-1B, H-2B, J-1 and L-1 visa holders from entering the US.
For this reason, we strongly advise any temporary visa holder who is outside the US and in the possession of a valid visa to return immediately to the U.S. For any temporary visa holder in the U.S, please do not make any international travel plans and ensure you remain in the U.S. until further notice.
The reported duration of this proclamation will be between 90 and 180 days, most likely at 120 days. It is possible that L-1A managers and executives would be exempt from this bar. We would also note that there will likely be exemptions for those who are performing COVID related medical research, healthcare professionals, and food supply workers. It is also possible there will be an exemption for any worker in these categories if the employer has performed certain additional recruitment efforts to locate American workers to fill these jobs, but have been unable to do so.
We will post more updates as the situation develops. Please contact our office at 215.925.0705 to speak with an attorney if you have any questions or concerns.
