September 2013 Visa Bulletin: F2A remains current; EB2 India advances to June 15, 2008; EB3 for All Other, Mexico, and China advances to July 1, 2010

The Department of State has released the September 2013 Visa Bulletin.  Here are the key updates:

Family based preference categories:

– The F2A category (spouses and unmarried children (under the age of 21) of lawful permanent residents) remains current for all countries;

Employment based preference categories:

All non-current categories other than EB2 China (which remains at August 8, 2008) saw progression in cut-off dates.

– 2nd preference for India will advance to June 15, 2008 (from January 1, 2008 in the current month)

– 3rd preference for India will advance to September 22, 2003 (from January 22, 2003 in the current month)

– 3rd preference for the Philippines will advance to December 1, 2006 (from October 22, 2006 in the current month)

-3rd preference for all other countries will advance to July 1, 2010 (from January 1, 2009 in the current month)

In addition, the Department of States has offered the following guidance with regards to future movement of cut-off dates:

It is unlikely that there will be any forward movement of most Employment-based cut-off dates during the next couple of months.  In addition, a sudden surge in demand could require the retrogression of a cut-off date at any time.  Such action would be required if it appears that such number use could impact visa availability under the FY-2014 annual limits.
